Terms of Service

The agreement, in plain English.

Effective May 5, 2026  ·  Last updated September 21, 2026

What the app is, what it isn't, and where you stand.

1. Agreement to Terms

By downloading, installing, or using Managed Pain Care (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User”) and Platinumaire LLC, a New Jersey limited liability company (“Company,” “we,” “our,” or “us”). The App is licensed to you, not sold.

2. Medical Disclaimer — Please Read Carefully

Important — Not Medical Advice

Managed Pain Care is a personal health tracking tool. It is NOT:

The pain patterns, correlations, and reports shown by the App are for personal informational purposes only. They do not constitute medical advice. The App does not diagnose conditions, and it does not predict future pain. It records what you logged and what the conditions were, and shows you the two side by side.

ALWAYS consult a qualified healthcare professional before making any changes to your medications, treatment plan, or health decisions. Never disregard professional medical advice or delay seeking it because of something you read in this App.

In a medical emergency, call 911 or your local emergency number immediately.

3. License Grant

Subject to your compliance with these Terms, Platinumaire LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use.

You may not:

4. FDA General Wellness Designation

Managed Pain Care is intended as a general wellness product. It is designed to help users maintain or encourage a healthy lifestyle by logging daily health factors, medications, and activities for personal awareness.

The App is not intended to diagnose, cure, treat, mitigate, or prevent any disease or medical condition. It does not meet the definition of a medical device under the Federal Food, Drug, and Cosmetic Act (FD&C Act) and is not subject to FDA oversight as a medical device.

5. User Responsibilities

By using the App, you agree to:

You are solely responsible for any health or medical decisions you make based on information displayed in the App.

6. Your Data

Your health data is stored on your device, not on our servers. We cannot retrieve, restore, or recover it for you — including if your device is lost, damaged, reset, or if you delete the App. Keeping your own backups or exports is your responsibility.

How your data is handled is described in full in our Privacy Policy, which forms part of these Terms.

7. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that any weather, environmental, or reference data displayed in it will be accurate, complete, or current. That data comes from third parties and we do not control it.

8. Limitation of Liability

To the maximum extent permitted by law, Platinumaire LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the App.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the App shall not exceed the greater of the amount you paid for the App in the twelve months preceding the claim, or twenty-five US dollars (US$25).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

9. Purchases and Subscriptions

Any paid features are sold through the Google Play Store and are subject to Google’s payment terms. Refunds are handled by Google according to their policy. We do not process, store, or ever see your payment card details.

10. Changes to the App

We may add, change, or remove features at any time. We may also stop offering the App entirely. Because your data is stored on your own device, it remains yours and accessible on that device regardless.

11. Termination

You may stop using the App at any time by deleting your data and uninstalling it. We may terminate this license if you materially breach these Terms. Sections 2, 6, 7, 8, and 12 survive termination.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Last Updated date at the top of this page. If the changes are material, we will notify you in the App before they take effect.
